Listing content, advertising claims, or representations made by the practitioner
Misuse of user information or lead data
Violation of these Terms

Governing Law

These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Florida.

Modifications

Program Fees and Billing

By purchasing the Accelerator Program online, the practitioner authorizes UCC Near Me to charge the payment method on file on a recurring monthly basis according to the selected plan.

Program fees are payable in advance at the start of each monthly billing cycle.
The Accelerator Program is month-to-month with a minimum commitment of one full billing cycle.
All payments are non-refundable once a billing cycle begins.
No partial refunds or prorated refunds will be issued for unused time within a billing cycle.
Failure to process payment may result in suspension or termination of Accelerator Program services.

No Pay-Per-Lead or Guaranteed Results

The Accelerator Program is not a pay-per-lead service and is not a guaranteed ROI service. UCC Near Me does not guarantee any specific number of leads, calls, appointments, patients, conversions, cost per lead, revenue, profit, search ranking, advertising result, or financial outcome.

UCC Near Me is not a healthcare provider and does not provide medical advice, diagnosis, treatment, or patient care. Practitioners are solely responsible for all patient interactions, diagnosis, treatment, care, outcomes, patient satisfaction, compliance, and medical decisions.

UCC Near Me shall have no liability for patient outcomes, patient satisfaction, medical decisions, treatment results, or any claims related to healthcare services provided by a practitioner.

Third-Party Platform Disclaimer

UCC Near Me is not responsible for issues caused by third-party platforms, including advertising account restrictions, ad account bans, policy changes, platform outages, tracking limitations, software issues, or changes made by Meta, Google, GoHighLevel, CallRail, Zapier, or any other third-party service provider.

Cancellation and Termination

Practitioners may cancel the Accelerator Program by providing written notice at least three (3) days before the next billing date. If cancellation notice is not received at least three (3) days before the next billing cycle, the next monthly payment may be charged in full.

Cancellation is not effective until received and confirmed by UCC Near Me. UCC Near Me may suspend or terminate Accelerator Program services at any time for non-payment, breach of these Terms, misuse of leads, regulatory concerns, unethical conduct, abusive behavior, or any conduct that may harm UCC Near Me, users, patients, or other practitioners.

Termination does not relieve the practitioner of any outstanding payment obligations. No refunds or prorated amounts shall be due upon cancellation, suspension, or termination.

Limited Territorial Exclusivity

If expressly offered as part of the Accelerator Program, UCC Near Me may provide limited territorial exclusivity for the Accelerator Program within fifteen (15) miles of the practitioner’s primary practice location.

Any such exclusivity applies only to the Accelerator Program and only while the practitioner remains active, current on all payments, and in good standing. Exclusivity does not apply to UCC Near Me’s directory, listings, other marketing services, other platforms, healthcare providers outside the defined radius, or any services not specifically included in the Accelerator Program.

Exclusivity is immediately revoked if the practitioner cancels, fails to pay, breaches these Terms, becomes inactive, or is no longer in good standing.

Confidentiality

Practitioners agree not to disclose UCC Near Me’s non-public pricing, strategies, systems, processes, advertising methods, funnels, campaign data, tracking systems, or proprietary business information to any third party.

Non-Disparagement

Additional Limitation of Liability

UCC Near Me shall not be liable for lost revenue, lost profits, missed opportunities, loss of patients, advertising performance, lead quality, user behavior, platform issues, service interruptions, indirect damages, incidental damages, consequential damages, special damages, or punitive damages.

Patient care, patient outcomes, or patient satisfaction
Professional negligence, malpractice, or alleged misconduct
Violation of any healthcare law, advertising rule, regulation, or professional standard
Misuse of leads, patient information, or user data
Failure to follow recommended call handling, scheduling, or intake procedures
Violation of these Accelerator Program Terms

Entire Agreement
